My firm is a third-generation boutique Elder Law and Estate Planning law firm located in the Western suburbs of Pittsburgh in Oakdale, Pennsylvania. We also serve clients throughout Pennsylvania and West Virginia.
I know the aging process all too well because I lived it with my mother-in-law.
My wife and I were faced with a situation where my mother-in-law became very ill and was unable to return home. The worst part was we knew her savings wouldn’t cover the nursing home bill for long.
Fortunately, with my background in Estate Planning, I was able to get her qualified for Medicaid to pay the nursing home and get her the care she needed.
That experience started my journey into Elder Law.

Here are the ones we hear most often.
Elder law and estate planning overlap in many ways. They both involve planning for your future as it relates to your wishes for your home, savings, investments, and other items (also called your assets).
The main difference is that elder law focuses more on planning for the use of your income and assets while you are alive, and estate planning focuses more on what will happen to your assets when you pass.
We help you prepare for future long term care costs. Currently in the Pittsburgh area, the average nursing home is $10,038 per month. That would devastate most families.
An Elder Law attorney can help you qualify for Medicaid or other benefits that can help pay for that expense, while protecting your home and other assets that can be passed down to your loved ones.

No. While there are strict requirements to meet for both income and assets, with proper planning you may become Medicaid eligible before spending all of your assets.

When a person dies without a Will, it is called Intestacy. In this case there is a statute that determines how the deceased’s assets are distributed.
Generally, surviving spouses and direct heirs are first to inherit an intestate estate. In their absence, aunts, uncles and cousins may inherit. It is a common misconception that the State will take all of your assets if you die without a Will.
It is only in the absence of any surviving heirs that the State would stand to inherit. To open an Intestate Estate, an Administrator must be appointed. Your first step is to contact our office for guidance.

If your other parent is still alive and they owned their property jointly, you likely do not have to do anything. Assets owned jointly by married individuals pass by operation of law to the survivor.
If your parent was a widow and he/she had a Will, the Will must be probated so the assets may be distributed accordingly.
